1. Definitions

Millia's Zorg: the company that offers home help, personal care, nursing, terminal care, bereavement counseling, and cleaning services.

Client: any natural person or legal entity that uses the services of Millia's Zorg.

Agreement: the care or service agreement between Millia's Zorg and the client.

Services: all forms of care, guidance or support provided by Millia's Zorg.
2. Applicability

These terms and conditions apply to all offers, agreements and activities of Millia's Zorg.

Deviations are only valid if agreed in writing.

If any provision is invalid, the remaining provisions shall remain in full force and effect.
3. Conclusion of the agreement

An agreement is concluded after verbal or written acceptance of an offer from Millia's Zorg.

All agreements are confirmed in a care agreement or order confirmation.

Millia's Zorg may refuse an assignment if execution would be irresponsible or contrary to laws and regulations.
4. Execution of the services
-
Millia's Zorg carries out its work carefully, professionally and with respect for the client's privacy and dignity.

The nature and extent of care are tailored to the client's needs.

The client provides correct and complete information necessary for responsible execution.

If performance is temporarily impossible due to illness, emergency, or force majeure, Millia's Zorg will notify you as soon as possible and will try to arrange a replacement if possible.
5. Duration and termination

The agreement is valid for an indefinite period, unless otherwise agreed.

Either party may terminate the agreement in writing with one month 's notice, unless there is an urgent reason (such as non-payment or misconduct).

In the event of the client’s death, the agreement ends automatically.
6. Rates and payment

Rates are agreed in advance and confirmed in writing.

Payment must be made within 14 days of invoice date, unless otherwise agreed.

In case of late payment, the client is in default and statutory interest and collection costs may be charged.

If care is financed through PGB, WLZ or WMO, the client remains responsible for timely payment.
7. Liability and indemnity

Millia's Zorg is solely liable for direct damage resulting from demonstrably negligent or careless conduct by it or its employees.

Liability is limited to the amount paid by Millia's Zorg's liability insurance. If the insurer does not pay out, liability is limited to the invoice amount for the month in which the damage occurred.

Millia's Zorg is not liable for indirect damage, consequential damage, emotional damage or lost income.

The client indemnifies Millia's Zorg and its employees against any damages or claims from third parties arising from incorrect information, careless actions, or omissions by the client themselves or persons around them.

The client is obliged to inform Millia's Zorg about circumstances that could affect the safety, health or well-being of employees.
8. Force Majeure

Force majeure means any circumstance beyond the control of Millia's Zorg, including illness, calamities, government measures or natural disasters.

In the event of force majeure, Millia's Zorg may suspend or terminate the agreement without compensation.
9. Privacy and confidentiality

Millia's Zorg processes personal data in accordance with the General Data Protection Regulation (GDPR).

All client data will be treated confidentially and used solely for the execution of the agreement.

Employees are bound by a duty of confidentiality and sign a confidentiality agreement.
10. Complaints and disputes

Millia's Zorg has a complaints procedure in accordance with the Healthcare Quality, Complaints and Disputes Act (Wkkgz) .

Complaints can be submitted in writing via [ info@milliasthuiszorg.nl].

The client will receive a written response within 6 weeks .

If the complaint is not resolved satisfactorily, the client can contact a recognised dispute resolution body or the Health and Youth Care Inspectorate (IGJ) .
11. Specific provisions for terminal care and bereavement counseling

Millia's Care provides these services with the utmost care, compassion, and respect for the wishes of the client and their loved ones.

Grief counseling is a form of emotional support; no guarantees can be made about the processing of loss or emotional outcomes.

Millia's Zorg is not liable for any psychological, emotional, or spiritual harm resulting from the experience or processing of terminal care or bereavement counseling.
12. Applicable law

All agreements are exclusively governed by Dutch law .

Disputes that are not resolved through the complaints procedure will be submitted to the competent court in the district where Millia's Zorg is located.
13. Final provision
Millia's Zorg reserves the right to amend these terms and conditions. The most current version is always available on the website or upon request.
